Griiip Privacy and Data Protection Policy

Griiip Automotive Engineering Ltd., and its subsidiaries (“Griiip”, “we”, “our” or the “Company”, and their cognates) respects the privacy of its Users and website visitors, and is committed to protecting the personal information you may share with us. Personal information (hereinafter, “Personal Data”) means any information that relates to an identified or identifiable natural person. We also protect our followers, vendors, service providers, partners and others who contact us (these and any others with respect to whom we collect personal data, shall collectively be referred to as “Users” or “you” or “Data Subjects”).


This policy and notice (the “Privacy Policy”) explains the types of information we may collect from you or that you may provide when you visit our website, https://www.griiip.com, use our applications (including the Griiip Performance web application and the Griiip Stream mobile app, described in section 2) or visit our social media pages, and the information you may provide us in the course of business transactions, sales and support. We are transparent about our practices regarding the information we may collect, use, maintain, and process and describe our practices in this policy and notice. Please read the following carefully to understand our practices regarding your personal data and how we will treat it.


Griiip aims to process only adequate, accurate and relevant data limited to the needs and purposes for which it is gathered. We also aim to store data for the period necessary to fulfill the purpose for which the data is gathered. Griiip only collects data in connection with a specific legitimate purpose and only processes data in accordance with this Privacy Policy. Our policies and practices are constantly evolving and improving, and we invite any suggestions for improvements, questions or comments concerning this Privacy Policy. You are welcome to contact us (details below) and we will make an effort to reply within a reasonable timeframe.


1. WHICH INFORMATION MAY WE COLLECT?


Identifiable Data

When you sign up to our website, or in processing data for our Users we collect several categories of personal data. Personal Data which is being gathered consists of any details which are personally identifiable provided consciously and voluntarily by you through your use of the website and our applications (as described below). This may include your name (first and last), email address, phone numbers, postal address or other identifier by which you may be contacted online or offline, login credentials, your Griiip account username and password and usage details, and other information you may choose to provide to Griiip. Additionally, we may obtain location data related to the geographic location of your laptop, mobile device or other digital device on which the Griiip website is used.


Griiip may also collect the email addresses of people who communicate with Griiip via email or other media or create accounts and login credentials.


By registering for an account or submitting requests for support or information via the website, Griiip will collect details, including also your name, phone number and personal or company email you provided, address and other such information. Griiip may use this information to offer Griiip’s services and support, and will share this data across Griiip group companies and affiliates to optimize its services.


Driving Data

When a drive is recorded with our products, for example with the Griiip Stream mobile app, an in-car device or camera, or our desktop app for racing simulators, we collect data about the drive, such as position, speed, lap and sector times, telemetry and video. We link it to the car it was recorded in and to the team, and to the driver once the drive is linked to their account.


Statistical Data

We may collect and share non-personally identifiable information (such as anonymous usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with third party service providers to help us understand the usage patterns for our service. This data does not identify you, and we may store it indefinitely.


When you are signed in to Griiip Performance, we also record some of what you do there, such as opening a session, viewing its statistics, using the AI coach or sharing a session, with your account identifier and the time. We use these records to understand how our services are used and to improve them, and we keep them until you delete your account (section 8). Griiip Performance also uses Google Analytics, which receives your account identifier while you are signed in.

You do not have any legal obligation to provide any information to Griiip, however, we may require certain information in order to provide any services and products. If you choose not to provide us with certain information, then we may not be able to provide you with some or all of the services.


2. THE GRIIIP STREAM MOBILE APP


Griiip Stream (shown as “GStream” on your phone’s home screen) is our app for iPhone and Android. Drivers use it to broadcast a drive from the car to their team: live video and audio from the phone’s camera and microphone, and live telemetry from the phone’s location and motion sensors or from a connected RaceBox GPS unit. The team watches the broadcast, and analyses the drive afterwards, in Griiip Performance. This section describes what the app collects and why. The rest of this Privacy Policy applies to the app as well.


Your account

The app does not create accounts. You sign in with your Griiip account, using your email address and password or your Google account. If you sign in with Google, Google shares basic profile information with us: your name, email address and profile picture. We use your name, email address and account identifier, the teams you belong to and your role in them, and the cars you may drive, to sign you in and to show you your teams, cars and sessions.


While you broadcast a drive

The app collects the following only during a broadcast, from the moment you go live until you end the broadcast. Some of it continues while your screen is locked or the app is in the background, so that the whole drive is recorded.


  • Location and motion. Your phone’s precise GPS position, speed, altitude and heading, and readings from its motion sensors (acceleration, rotation and orientation). If you connect a RaceBox unit, the same kinds of readings come from it. We use them to time your laps and sectors, to calculate telemetry and analysis of the drive, and to show your car on your team’s live map.

  • Camera video. The view from your phone’s camera, streamed live to your team.

  • Microphone audio. Sound from your phone’s microphone, streamed with the video. You can turn this off in the app’s Settings (“Broadcast microphone”). If you do not allow microphone access, the broadcast continues with video only.

  • Talkback. If you turn on talkback (“Let the pit talk to me” in Settings), members of your team can speak to you through the phone during the broadcast. Before you turn it on, the app tells you that what they say is recorded with the drive’s video.

  • Technical details. Such as the GPS accuracy and your phone’s temperature state, so that we can keep the broadcast running.

  • Drive details. The car you drive (including its vehicle identification number), the track and session you choose, and the times of the drive.


Recording. We record the live broadcast, including its audio and anything said over talkback, as the drive’s video. Your team can replay it in Griiip Performance alongside the drive’s telemetry.


Full-HD copy on your phone. The app also records a full-quality copy of the drive on your phone. The copy includes your microphone audio if you broadcast with audio, but not talkback. It stays on your phone and is deleted automatically after 7 days (you can choose between 1 and 30 days in Settings), or when you uninstall the app. If a member of your team asks for the full-HD video of that drive, the app uploads the copy to us, and it becomes the drive’s video in Griiip Performance. You can choose in Settings to upload only over Wi-Fi.


Before a broadcast

To list the tracks and sessions nearest to you first, the app may read your phone’s last known location. This is used on your phone only and is not sent to us.


Bluetooth

If you use a RaceBox GPS unit, the app uses Bluetooth to find it and connect to it. The app does not use Bluetooth to determine your location.


Notifications

The app registers your phone for push notifications with Google’s Firebase Cloud Messaging (on iPhone, through Apple’s Push Notification service). It sends us the resulting device token together with the car and the times of each full-HD copy your phone holds. We use the token only to let your team ask your phone for a full-HD video, and we delete it after 8 days.


Crash reports

The Android app sends crash and error reports to Google’s Firebase Crashlytics, so that we can find and fix faults. A report contains technical details, such as the phone model, the versions of the operating system and the app, the error itself, and an identifier for the app installation. It does not include your name or email address. The iPhone app does not include a crash-reporting service. If you have chosen, in your iPhone’s settings, to share analytics with app developers, Apple may share crash reports with us.


What the app does not do

The app shows no advertising and contains no advertising or analytics tools. It does not track you across other companies’ apps or websites, and it does not access your contacts or your photo library.


Permissions

The app asks for access to your camera, microphone, location (only while you use the app), Bluetooth and notifications. Reading the motion sensors needs no permission, on iPhone or Android. You can withdraw any of these permissions at any time in your phone’s settings. The features that need them then stop working: for example, without location the app cannot time your laps.


Who can see your broadcast

Your live video, audio, location and telemetry, and your recorded drives, are available in Griiip Performance to the members of the team you broadcast for. Most team roles see all of the team’s cars; members who are limited to certain cars see only those cars. Team administrators decide who belongs to the team and which cars each member can see. Authorised Griiip staff can also access them, to run and support the service.


A team member can share a drive’s coaching view through a read-only link. Anyone who has the link can open it, for up to 72 hours.


3. HOW DO WE COLLECT PERSONAL DATA

THROUGHOUT OUR SERVICES?


We collect Personal Data through your use of our website, our applications, or social media pages. When such use is made by you, we are aware of it and gather, collect and record the information relating to such usage, either independently or through the help of third-party services as detailed below. This includes technical information and behavioural information such as the User’s Internet protocol (IP) address used to connect your computer to the Internet, your uniform resource locators (URL), operating system, type of browser, browser plug-in types and versions, screen resolution, time zone setting, the User’s ‘clickstream’ on the website, the period of time the User visited the website, methods used to browse away from a page, and any phone number used to call our User service number. We likewise place cookies on your browsing devices (see section ‘Cookies’ below), though you may block these.

In the Griiip Stream mobile app, we collect data from your phone’s camera, microphone, location and motion sensors, and from a connected RaceBox unit, only as described in section 2 and only with the permissions you grant on your phone. Our sign-in provider, Firebase Authentication, also records the IP address you sign in from, to protect your account.

We collect Personal Data required to provide services when you register interest and/or open an account. In addition, we collect your Personal Data, when you provide us such information by entering it manually or automatically, or through your use of our website, facilities and services, or in connection with site visits, in the course of preparing a contract, or otherwise in engaging with us.


4. WHAT ARE THE PURPOSES OF PERSONAL DATA WE COLLECT?


We will use Personal Data to provide and improve our services to our Users and others and meet our contractual, ethical and legal obligations, including for example:

  • to present our website and its contents to you;

  • administering your account with Griiip including to identify and authenticate you;

  • to provide you with the information, products and services that you request from Griiip;

  • to broadcast your drive live to your team, to record it, and to let your team replay and analyse it;

  • to time your laps and sectors, and to calculate telemetry and analysis, from your location and motion data;

  • to deliver the full-HD video of a drive when your team asks for it, using push notifications to your phone;

  • to detect, diagnose and fix crashes and errors in our apps;

  • verifying and carry out financial transactions in relation to payments you make in connection with the products;

  • contacting you for the purpose of providing you with technical assistance and other related information about the products;

  • to allow you to participate in interactive features on our website;

  • to carry out and enforce our rights arising from any contracts entered into between you and us, including for billing and collection;

  • notifying you about changes to our service and products;

  • replying to your queries, troubleshooting problems, detecting and protecting against error, fraud or other criminal activity;

  • contacting you to give you commercial and marketing information about events or promotions or additional services and products offered by us and our cognates, including in other locations;

  • soliciting feedback in connection with your use of the services; tracking use of Griiip facilities and services to enable us to optimize them;

  • contacting you to inform you of additional services offered by us or our cognates which may be of interest to you;

  • compliance and audit purposes, such as meeting our reporting obligations in our various jurisdictions, and for crime prevention and prosecution in so far as it relates to our staff, Users, facilities etc;

  • if necessary, we will use personal data to enforce our terms, policies and legal agreements, to comply with court orders and warrants and assist law enforcement agencies as required by law, to collect debts, to prevent fraud, infringements, identity thefts and any other service misuse, and to take any action in any legal dispute and proceeding;

  • for security purposes and to identify and authenticate your access to the parts of the facilities;

  • to process a request to delete your account, and to restore the account if you ask us to during the restore period (section 8).


Where the GDPR applies, we process Personal Data because it is necessary to perform our contract with you (for example, to provide the services, including the app’s broadcasting, recording and analysis); for our legitimate interests (for example, security, fixing faults and improving our services), where those interests are not overridden by your rights; with your consent, where the law requires it (for example, for marketing communications); or to comply with our legal obligations.


We do not sell Personal Data, and we do not use data from the Griiip Stream app for advertising.


5. DATA SHARING


We may transfer personal data within our group, and to third party service providers as follows:


Your Team. What you broadcast with the Griiip Stream app, and drives linked to a team, are shared with the members of that team, as described in section 2 (“Who can see your broadcast”).


Public and Shared Information. Your Griiip Performance profile page is public: anyone with its link can see your name, country, bio and lap statistics, including your best laps. World Records, which any signed-in user can see, show the name, lap time and date of each record lap. Laps from real-world drives are not included. If a team connects a Discord channel, new records set by its drivers are posted there, with the driver’s name and a link to their profile.


Affiliates and Subsidiaries. This includes any member of our group, which means the Griiip parent company and subsidiaries – whether wholly or partially owned by Griiip, including other services we offer to our clients, including third parties. When we share data with our affiliates and subsidiaries, we will not use identified personal data.


Third Party Service Providers. We transfer personal data to third parties in a variety of circumstances for the provisions of our Services to you. We endeavour to ensure that these third parties use your information only to the extent necessary to perform their functions, and to have a contract in place with them to govern their processing on our behalf. These third parties assist us in providing the services we offer, processing transactions, fulfilling requests for information, receiving and sending communications, analysing data, providing IT and other support services or in other tasks, from time to time. These third parties also include analytics and search engine providers that assist us in the improvement and optimization of our websites, and our marketing.


We periodically add and remove third party providers. At present our third-party providers to whom we may transfer personal data include the following: Google (Google Cloud, where our servers, databases and files are hosted; Firebase Authentication, for sign-in; Firebase Cloud Messaging, for push notifications; Firebase Crashlytics, for crash reports from our Android app; Google Analytics, which measures how Griiip Performance is used; and Google Maps Platform, to name the place where a drive took place); Apple (Apple Push Notification service, to deliver notifications to iPhones); LiveKit (LiveKit Cloud, which streams live video and audio and records broadcasts); Microsoft (Azure OpenAI Service, which generates our AI analysis of laps and answers questions in our AI coach: it receives lap and telemetry data and your questions, but not your name or email address); Resend (account, invitation and support emails); Mailchimp (marketing emails); New Relic (monitoring of our servers); the makers of the in-car devices and cameras some teams use, such as Ituran; and, for drives at certain partner tracks, that track’s partner; contracted developers; designers and consultants, our lawyers, accountants, local payroll service providers, other standard business service providers; Other industry standard business software and partners.


Change of Control. In addition, we will disclose your personal data to third parties if some or all of our companies or assets are acquired by a third party including by way of a merger, share acquisition, asset purchase or any similar transaction, in which case personal data may be one of the transferred assets.


Legal obligation. We will transfer personal data to third parties if we are under a legal duty to disclose or share your personal data in order to comply with any legal or audit or compliance obligation, in the course of any legal or regulatory proceeding or investigation, or in order to enforce or apply our terms and other agreements with you or with a third party; or to assert or protect the rights, property, or safety of Griiip, our Users, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction and to prevent cybercrime.


You also may provide information to be published or displayed (hereinafter, “posted”) on public areas of the Site, or transmitted to other users of the Site or third parties (collectively, “User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. Although we limit access to certain pages/you may set certain privacy settings for such information by logging into your account profile, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Site with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.


For avoidance of doubt, Griiip may transfer and disclose non-personal data to third parties at its own discretion.


6. WHERE DO WE STORE YOUR DATA?


We keep Personal Data in servers that are controlled by Griiip through reputable cloud-service providers in the US. Our main provider is Google Cloud, in the United States. Some providers process data in other countries: LiveKit routes live video and audio through servers close to the people taking part; New Relic, our monitoring provider, keeps its data in the European Union; and the Ituran cameras some teams use send video through servers in Germany and Brazil. Recordings that the Griiip Stream app keeps on your phone stay on your phone until they are deleted or uploaded (section 2).


7. INTERNATIONAL DATA TRANSFERS


We may transfer your personal data outside of the EEA to the US, in order to:


  • store or backup the information;

  • enable us to provide you with the services and products and fulfil our contract with you;

  • fulfil any legal, audit, ethical or compliance obligations which require us to make that transfer;

  • facilitate the operation of our group businesses, where it is in our legitimate interests and we have concluded these are not overridden by your rights;

  • to serve our Users across multiple jurisdictions; and

  • to operate our subsidiaries and affiliates in an efficient and optimal manner if relevant.


When we do, we rely on appropriate safeguards, such as our service providers’ certification under the EU-U.S. Data Privacy Framework, or the European Commission’s Standard Contractual Clauses.


8. DATA RETENTION


Griiip retains personal data for as long as required to provide the services, or for other reasons. Our Users decide when to delete data they control.


Griiip will retain personal data it processes only for as long as required in our view, to provide the services and as necessary to comply with our legal and other obligations, to resolve disputes and to enforce agreements. We will also retain personal data to meet any audit, compliance and business best-practices.


Data with respect to which Griiip is the Processor may be deleted only on action and/or instruction of the Controller, except where such data must be retained by us, in our judgment, as above. Data that is no longer retained may be anonymized or deleted. Likewise, some metadata and statistical information concerning the use of our services are not subject to the deletion procedures in this policy and may be retained by Griiip. We will not be able to identify you from this data. Some data may also be retained on our third-party service providers’ servers until deleted in accordance with their privacy policy and their retention policy.


Specific retention periods:

  • Your account: for as long as you have it. When you delete it (section 11), it is closed at once, and we can restore it for 30 days. After that, we permanently delete your sign-in account and profile; your conversations with the AI coach and your activity records; your saved chart layouts and the share links you created; and every team that closed with your account, with its drives, videos and telemetry. We also remove you from our marketing list.

  • Drives recorded with a team that carries on after you delete your account (a team you were a member of, or one that passed to another administrator) stay with that team, so that the team keeps its record. We remove your name and the link to your account: the drives show “Deleted driver”, and you are taken off the team’s list of drivers. Comments you left on the team’s drives stay too, without your name.

  • Drives, with their video and telemetry: for as long as the team keeps them. Drives, sessions and teams that are deleted are kept for 30 days, so that they can be restored, and are then deleted permanently.

  • Full-HD copies on your phone: 7 days by default (from 1 to 30 days, as you choose in the app’s Settings), or until you uninstall the app.

  • Push notification tokens: 8 days.

  • Server logs: 30 days.

  • Crash reports from the Android app: 90 days (Firebase Crashlytics).

  • Your conversations with the AI coach, and your activity records in Griiip Performance: until you delete your account.

  • Google Analytics: up to 14 months.

  • IP addresses recorded at sign-in: a few weeks (Firebase Authentication).

  • Backups: up to 7 days.

  • Our marketing list: until you unsubscribe or delete your account.


9. SERVICES AND WEBSITE DATA COLLECTION AND COOKIES


When you access or use our services or websites, Griiip may use industry standard technologies such as cookies, pixels and similar technologies, which store certain information on your computer or browsing device and which will allow us to identify the computer or device and, in some cases, to identify them with the user, and to enable automatic activation of certain features, and make your user experience more convenient and effortless. We use different types of cookies: some cookies are strictly necessary, they are required for the operation of our website and services under our terms with you; this includes for example, cookies that enable you to log into secure areas of our services. We also use analytical and performance monitoring cookies, which allow us to recognise and count the number of visitors and to see how visitors move around our website and services when they are using it. Finally, we use functionality cookies which are used to recognise you when you return to our Site. This enables us to personalise content to your preferences, including for example, your choice of language or region. You may control these in your browser settings. See our cookie policy here.


The Griiip Stream mobile app does not use cookies or advertising identifiers. It keeps your sign-in and your settings on your phone.


Our services and website may, from time to time, contain links to external sites. We are not responsible for the operation, privacy policies and practices or the content of such sites.


10. INFORMATION SECURITY


No data security is perfect, but we work hard to ensure we have great security.


We take great care in implementing, enforcing and maintaining the security of the personal data we process, whether as Processor or as Controller. Griiip implements, enforces and maintains security measures, technologies and policies to prevent the unauthorized or accidental access to or destruction, loss, modification, use or disclosure of personal data. We likewise take steps to monitor compliance of such policies on an ongoing basis. Where we deem it necessary in light of the nature of the data in question and the risks to data subjects, we may encrypt data. Likewise, we take industry standard steps to ensure our websites and services are safe. Data travelling between our apps and our servers, including live video, audio and telemetry, is encrypted in transit, and our cloud provider encrypts the data it stores for us.


Note however, that no data security measures are perfect or impenetrable, and we cannot guarantee that unauthorized access, leaks, viruses and other data security breaches will never occur.


Within Griiip, we endeavour to limit access to personal data to those of our personnel who: (i) require access in order for Griiip to fulfil its obligations, including also under its agreements, and as described in this Privacy Policy, and (ii) have been appropriately and periodically trained with respect to the requirements applicable to the processing, care and handling of the Personal Data, and (iii) are under confidentiality obligations as may be required under applicable law.


Griiip shall act in accordance with its policies and with applicable law to promptly notify the relevant authorities and data subjects in the event that any personal data processed by Griiip is lost, stolen, or where there has been any unauthorized access to it, all in accordance with applicable law and on the instructions of qualified authority. Griiip shall promptly take reasonable remedial measures.


11. DATA SUBJECT RIGHTS


Data subjects have rights, and we respect them.


We enable privacy rights under generally accepted data protection laws, including the GDPR as follows: Rights to data portability; Rights to access data; Right to rectify data; Right to restrict processing; Right to object to processing; Right to erase data; and, where we rely on your consent, the Right to withdraw it at any time.


Data subjects in the EU have the right to lodge a complaint, with a data protection supervisory authority in the place of their habitual residence.


If, for any reason, a data subject wishes to modify, delete or retrieve their Personal Data, they may do so, where applicable, by contacting us at support@griiip.com.


Deleting your account. You can delete your account in the Griiip Stream app (Settings → Delete account), or by emailing support@griiip.com from the address you sign in with. The app asks you to sign in again first, to confirm that it’s you. Deleting closes your account at once: you can no longer sign in, and you are signed out on every device. A team you own passes to its longest-standing other administrator; if it has no other administrator, the team is closed with your account. For 30 days, we can restore your account, and a team closed with it, if you ask us. After that, the account is deleted permanently, as described in section 8. griiip.com/delete-account explains what we delete and what we keep.


Marketing emails. You can unsubscribe from our marketing emails at any time, using the link in any of them, or by contacting us.


App permissions and settings. You can withdraw the Griiip Stream app’s access to your camera, microphone, location, Bluetooth or notifications at any time in your phone’s settings. In the app’s Settings, you can also stop sending microphone audio with your broadcasts, and turn talkback off.

Note that Griiip will have to undertake a process to identify a data subject exercising their rights. Griiip keeps details of such rights exercised for its own compliance and audit requirements. Please note that Personal Data may be either deleted or retained in an aggregated manner without being linked to any identifiers or Personal Data, depending on technical commercial capability. Such information will continue to be used by Griiip.

Note, that data subject rights cannot be exercised in a manner inconsistent with the rights of Griiip employees and staff, with Griiip proprietary rights, and third-party rights.


12. GENERAL


Minors. We do not knowingly collect or solicit information or data from children under the age of 16 or knowingly allow children under the age of 16 to register for Griiip services. If you are under 16, do not register or attempt to register for any of the Griiip Service or send any information about yourself to us. If we learn that we have collected or have been sent Personal Data from a child under the age of 16, we will delete that Personal Data as soon as reasonably practicable without any liability to Griiip. If you believe that we might have collected or been sent information from a minor under the age of 16, please contact us at: support@griiip.com, as soon as possible.


Changes to this Privacy Policy. The terms of this Privacy Policy will govern the use of the services, website, and any information collected in connection with them. Griiip may amend or update this Privacy Policy from time to time. The most current version of this Privacy Policy will be available at: https://www.griiip.com/privacy-policy. Changes to this Privacy Policy are effective as of the stated “Last modified” date and your continued use of our services will constitute your active acceptance of the changes to and terms of the Privacy Policy. If we make a material change, for example to how the Griiip Stream app uses your data, we will take reasonable steps to tell you in advance, for example in the app or by email.
